SafeWork NSW has announced a review of 20 Codes of Practice that were written before the Work Health and Safety Act 2011 and 2017 Regulation, and is seeking feedback on the following Codes of Practice:
- Code of Practice for the Collection of Domestic Waste
- Code of Practice for Moving Plant on Construction Sites
- Code of Practice for Safety in Forest Harvesting Operations
- Code of Practice for Tunnels Under Construction
- Code of Practice – Work Near Overhead Power Lines
One of the codes under review is the Code of Practice: Collection of Domestic Waste. This Code started in 2005 and, importantly, it contains provisions for dispute resolution procedures in relation to waste services. Submissions regarding this code are due to SafeWork NSW by 5pm on Monday 19 June 2023.
Local Government NSW is seeking members’ views on whether the codes under review (including but not limited to the Code of Practice: Collection of Domestic Waste), are still relevant and whether they support current and evolving work practices.
In particular, LGNSW is seeking views on whether the dispute resolution procedure in clause 3.8 of the Code of Practice: Collection of Domestic Waste is still relevant for councils.
Subject to member feedback, LGNSW may make a sector-wide submission in response to the codes under review. We also encourage members to make separate submissions for the consideration of SafeWork NSW.
