An illegal tobacco shop has been shut down in Coonabarabran as part of a joint operation by Warrumbungle Shire Council and NSW Police.
Council said the operation followed reports received from the local community about alleged illicit tobacco product sales from the newly opened premises in John Street, which presented as a ‘giftware’ shop.
Based on evidence gathered during the investigation, Council officers together with NSW Police Force Orana Mid-Western Police District officers, executed a search warrant at the premises.
During the operation, investigators located two individuals and a quantity of illicit tobacco products, including nicotine vapes, cigarettes and loose packaged tobacco commonly known as ‘chop-chop’. Police also seized a quantity of cash alleged to be proceeds from approximately two hours of trade.
Investigators also identified a CCTV surveillance system operating within the premises, which appeared to allow an individual based in Brisbane to direct operations via a live stream.
Council says the inspection identified further concerns regarding the use and safety of the premises.
“The two individuals were found to be residing in a rear room, sleeping on blankets on a concrete floor without access to bathroom or kitchen facilities. The premises was also found to lack required essential fire safety measures,” it said in a statement.
“Additional inquiries during the operation led Police to search a Queensland-registered vehicle located in the Woolworths car park behind the premises. Three large bags containing alleged illicit tobacco products were located in the vehicle.
“The illicit tobacco product and the CCTV system were seized as part of the operation and Police subsequently arrested the two individuals located at the premises.”
Police subsequently charged the two individuals with a number of alleged offences, including possession of greater than commercial quantity of illicit tobacco, deal in proceeds of crime, having goods in custody suspected of being stolen or otherwise unlawfully obtained, conduct prohibited development, conduct development without consent and mislead/provide false information to investigation officer. The two individuals were granted bail to appear before Coonabarabran Local Court on 22 September.
At the conclusion of the joint operation, an Emergency Stop Use order was served on both individuals present and the registered owners, prohibiting any further use or occupation of the premises.
Council says its investigations into the matter are continuing.
“Warrumbungle Shire Council remains committed to working collaboratively with the NSW Police Force to eliminate the illegal sale of tobacco products from premises within the region. The unlawful sale and distribution of illicit tobacco poses risks to public health and community safety, impacts local amenity and undermines legitimate local businesses,” it stated.
